    Need advice

    My 30 yr. old daughter has drawn SSD since she was 15 yrs. old because a car wreck left her a paraplegic. In December 2008 she was involved in a wreck that totalled out her vechile and caused her to have surgery. The other ladies insurance is finally going to settle for the max on the policy of $50,000. After legal fees my daughter should get around $30,000. Plus her insurance company will be paying off under the under insured portion of her policy for around $50,000. Will these settlements effect her SSD and does she have to report these funds to SS?

    Is she getting SSDI or is she getting SSI?

    I do not believe SSDI is means tested, while SSI  is means tested--but you want to be sure to triple check as I could be wrong!

    Just to be clear, I assume that she is getting benefits as a disabled child from a deceased or disabled parent's SS account.  A 15 year old generally would not have had enough of a work history at age 15 to qualify for SSDI on her own SSN.

    As long as it is not SSI, you should be OK.  SSI is a program that looks at household income, etc.  A settlement of this type definitely will affect those benefits.
