    work comp and heart attacks

    california ...if you have a heart attack on the job is that covered?  employer overworked the men through thanksgiving..the job was 300 miles from home,supposed to have motel room paid by employer but only motorhome on job site had to share with 2 men and one kid. job was to pay 18.00 but boss only paid 13.00 cause serious stress. covered?  Question

    Just because it happened at work doesn't mean it was caused by work.  Although all of that you mention may have been uncomfortable and "stressful", it will almost certainly NOT be a work comp incident.  People don't have heart attacks based on such things you noted without having heart problems way before this.  And I should know, I've had two of them.

    Who are you in this scenario?

    Agree with PattyPA...

    Ask yourself this question.. for an injury/illness to be compensable under WC rules, it must meet the AOE/COE standard... Arising Out of your Employment, and in the Course Of performing your Employment (job duties). Can't be just one side of that, must meet both criteria.

    Do you believe, with your Dr, your heart attack was under those conditions ?

    You may have action with the labor board. You can file a claim there for not receiving agreed upon wages. There may or may not be any action you can take regarding the 'reasonable accommodation'.
