    petition to remove name from sex offender registry

    my fiance was adjudicated as a juvenile (age 13) of csc 2nd degree....he doesn't qualify for expungement because it was 2nd degree, the judge told him to file for a petition to have his name removed from the PSOR, one catch, I guess the government only offered a small window of opportunity for this to be done and if you didn't do it in that window you missed the boat ( I live in Michigan)  He was never informed of the opportunity to file this petition.  he has a clean record, he is 26 years old....can we file a motion to have name removed and change of restrictions, giving adequate cause (death threats etc..)  From what I've researched it is the juvenile justice specialists job to inform juvenile sex offenders of all registration changes and any opportunity to have their name removed etc...why was my fiance not informed of this once in a lifetime opportunity and what can we do....I am preparing to file a motion with the court if that is possible....I'm willing to do anything possible.....

    This is probably not what you wanted to hear, but YOU should not prepare or file any motions or any other court documents for your fiancé. That constitutes the practice of law, and doing that without a license to practice law puts you in violation of the law.

    What he needs to do is consult a criminal defense attorney familiar with the state's sex offender registration laws for help. This is too important to try as a do-it-yourself project. If your fiancé messes this up, he might not get another shot at it.

    When my son was 18 he had sex with a girl that ended up being 13. Long story short the girl’s mother got mad later and had him arrested. Two yrs. went by; he had to stay in jail for 2-3 months until they lowered the bond. It was 2degree rape i believe. I will get all the facts. What they use to call statutory rape when I was young. He was convicted at 20, he’s on probation for 5 yrs. but he’s not attracted to little Girls in anyway. He tries to live somewhere, they kick him out. He moved in with a friend at a trailer park or private park and they kicked the man out he was room-mating with after they received flyer's, My son moved out soon as word got out, it was less than a week, can they do that to the gentleman that has a lease? Can my son file a petition to remove name from sex offender registry. My son knows of servile Guys that had sex with this girl before and after the matter. I was accidentally shot in the back, paralyzed in 97 in my place of business, professional Locksmith and security. My kids walked in when it happen. They had problems for a while but now we all live a normal lifestyle except me, and my son fighting to prove himself a law abiding tax paying citizen, not a sex predator. My life has been a living nightmare ever since I was shot. My kids are lucky to be doing as good as they are now. My story extreme spasms, pain, wound care, nurse care etc. I'm so upset for my son I get sick thinking about it. I love my kids they’re the only reason I chose to live. He has a heart and good head. He’s also a musician. If my wounds would heal I'm going to use my talents to Mix and promote their band. They play Birthday and Bar Shows to put back in the business. I'm proud of him all 3 of my kids and Sick that so many teenagers are on the same list as Sex predators. It’s hard for me to heal with all the stress and the fact that the man shoots me, paralyzes me was broke I didn’t get a dime or an apology. I suffered the consequences. My wife left a yr. later, She doesnt do much for them. I'm in pain but just wanted to run this by the Members.

    If he is still on probation he almost certainly cannot seek to be removed from the registry.  It depends on state law and no attorneys from AL are on the boards.

    His probation officer should be able to point him towards residences that will accept RSOs.

    Doesn't matter if the girl is the sluttiest *** in slutville, if she is 13 it is illegal to have sex with her.  Persons under the age of consent have no ability whatsoever to consent to sex.  None.

    I don't get the first case of the kid being 13 and being on sex offender since then. Doesn't old reccords clear by age 18 ?


    And about the 18 years old teenager with the 13 years old girl, it's no rape, even if the guy is over 18.
    He has 5 years of difference with the girl so it doesn't enter in the definition of pedophile where there should be more than 5 years.
    She was under 15, legal age of consent. But did she lie on age ?
    According to the story, I'd say yes.
    I'm 23, and I've to agree many girls aged 13-14 look as old as I do. And it's not rare to see them to nightclubs, where it's forbidden to enter before age 18.
    Where did the boy meet the girl ? If it's in her middle school, it's his fault. If she was in a place forbidden to kids and she lied about age, the guy is the victim and the parents of the girl should be taken as responsibles.

    Where were they when their child went out to play with her physics and pretended to be an adult ?

    It's easy for a girl 13 to pretend she's 16...

    First: you have activated an old post. It is doubtful the OP will be back now.

    Not when it comes to sexual offenses.

    Yes it is.  Many states have enacted laws that it doesn't matter if one party is of age to consent.  If there is an age difference between the two greater than a specified number of years it is statutory rape.  In some states it is as little as 3-4 years in most it is 5 years in age difference.

    The age of consent in some states is 15 but if there is a significant age difference it can still be charged as rape.  It doesn't matter if the minor lies about their age.  The burden is on the person who is older to accurately verify age and NOT get involved if there is the slightest uncertainty.

    What you fail to understand is it doesn't matter.  The older of the two involved with each other bears the burden of NOT getting involved with a minor.  That is how the law works.

    Doesn't matter if the minor pretends to be 18.  The burden is on the other person to KNOW their age and NOT get involved when they find out the other person is a minor.

    Juvenile records are normally not available to the public, but the government can normally still have complete access to them.

    - it is statutory rape, just different than forcible rape

    - Most states don't bother to define what a pedophile is.

    - Normally doesn't matter if a juvenile lies about age.  The burden is on the adult.  Kids are expected to lie.

    - The guy NEVER is the victim of statutory rape of a juvenile female.  Get a grip on reality.

    I'm in a lot of physical pain. Trying to make this quick., My son was 18 when this happen. What idiot decided 18 was an adult? I know your not an adult at 18. your Brain is still growing. 21 is barely an adult. According to many laws, the states and government continues to pick and choose what ages can do this or that. Its all relates to Money. How much money you can get out of someone asap, at that certain age. I cant do anything about it, I was shot in the back and paralyzed when he was a kid. it ruined my life and damaged his. Just have to wait and let him make enough money to buy his way out. I don't think I will live long enough to help him. I know this much, hes not a pedophile. Hes a hard worker, was just a kid when this happen. most guys have broken this law. The girl usually don't tell. Shes fine anyway, hes the one suffering..He moved in with his guy friend two months ago. My son notified the park he was a registered sex offender, they kicked my son and his friend out who didn't do anything. They don't want the details. or they assumed he raped her,. Anyway his friend Killed himself. Its been hell. I have to go. I don't plan on writing again. I have a site and my health prevents me from updating it. Praying for Peace

    So, you are telling us that a 13 year old girl is old enough and mature enough to consent to sex, but your 18 year old son is still an immature boy who cannot be held responsible for his actions?

    Give me a break.

    This happen over 3 yrs ago. hes not 18, shes not 13 anymore, No shes not suffering. She was having sex with older guys and kept having sex with older guys. My son Only had sex with her one time. It was a one time affair. She didn't want to get him in trouble, the law did. The mother got mad at my x-wife and Boyfriend, That started the whole mess. It was just to get back at them, and for the police to get money out of my son. Hes not going to have sex with underage girls. He knows better, He doesn't want to and isn't attracted to them. I would watch what you say. what goes around comes around. . I think you have skeletons in your closet. Let it Go. Peace,

    What you don't seem to understand is NONE of that matters.  It doesn't matter how many other guys the girl slept with.  Your son chose to think with his zipper instead of the brain between his ears.  The burden is on HIM to not have sexual intercourse with a minor.  If he hadn't had sex with her it wouldn't have mattered HOW angry anyone got; they wouldn't have had a cause of action.

    But he was attracted enough to an underage girl that he DID have sex with her.  That's the problem.
