Hello. I and many (possibly all) of my co-workers have received letters from the human resources department stating our I-9 forms were not completed in their entirety. The letter states "In completing a recent audit it was discovered that your I-9 form that was turned in when you were hired was not completed in its entirety. All employees are required to complete this form and present the ID specified by the form in order to continue employment here."
On the form, there are instructions under the heading "Filling Out Form I-9" marked "Section 1, Employee". It states "THIS PART OF THE FORM MUST BE COMPLETED NO LATER THAN THE TIME OF HIRE, WHICH IS THE ACTUAL BEGINNING OF EMPLOYMENT." The end of this paragraph states "THE EMPLOYER IS RESPONSIBLE FOR ENSURING THAT SECTION 1 IS TIMELY AND PROPERLY COMPLETED."
I know I filled this form out at time of hire, and if I didn't, then obviously, according to these instructions, my company has been in violation of Federal Law for (in my case) 14 months. Most of these other people have been under this company's employment longer than I. If I refuse to fill this paper out and get terminated, do I have a case? Thanks.
