    Neighbors surface runoff casing damage to my property

    My rear yard neighbors yard is sloped towards mine. Soil and surface water runoff are causing severe erosion of my lawn and causing soil to be washed into my driveway. We are not good terms. Can anyone confirm whether the neighbor is obliged to remedy the problem and assume the expense? I spoke with Maplewood Engineering Department and was told this is a "civil matter".

    Yes its a civil matter and in general if your neighbor altered the natural water runnoff by such things as drains, impervious surfaces, new slopes etc then the neighbor is responsible for the damages caused by same.

    You use a good RE attorney to review your facts and you sue him in court.

    Will not be cheap but if the facts support your case you should eventually prevail.

    PS ask counsel if a lis pendens is useful/workable
