Can I call my Hubbys work and ask for his cell phone records

    Can I call my Hubbys work and ask for his cell phone records

    My husband and I are considering seperation or divorce.  He has had an affair a couple years ago and I am pretty sure he may be having another one.  I caught him texting this girl from work on his personal phone which I saw on our phone bill.  He said she was just a friend and would stop texting with her.

    Well, then I saw when he was gone and his work phone was here that they were still texting. 

    His feelings have changed for me and I pretty sure it is because he found someone else.

     

    Can I call his work and ask for copies of his records?

    You can call.

    You can ask.

    But they sure as heck aren't going to give them to you.

    Besides, you can get a divorce simply because you want one.

    I am not the one that wants one he is considering it.  I want my family to stay together as we have two children....I am begging him not to leave...However I don't trust him and need to know if he is being honest with me.

    Short of a court order, your husband's employer has absolutely no legal obligation whatsoever to provide you with his cell phone records.

    You can ask.

    If they say no (and they will) then there is no law you can invoke that will force them to do so.

    His employer has no reason whatsoever to give you cell phone records. If you want a divorce, file. You know he cheats. He is probably going to keep cheating. Either accept the fact your husband is not faithful, and maybe ask him to go to counselling, or file for divorce. WA is a no fault state anyways so it really doesn't matter if hes having an affair or not. You may be entitled to some spousal support depending on the legth of the marriage. If I were you, get him into counselling. If he won't go then you have your answer on whether or not he wants to stay married.

    Of course, you can call and ask for anything you like.

    But I doubt they are going to be mailing or emailing you off his phone records.

    You could potentially successfully get him fired if that is your objective?

    But it all sounds like a waste of time to me.

    You already know he was texting this woman from his personal phones.  Odds are pretty good he's texting her from his work phone now.  If you get a record of it, what good is that going to really do you?

    He either wants to be married or he does not.  I don't see how calling his work, and confirming or not is going to change anything.  Either way, you don't trust him right now.  Even if he came up clean, you'd still want daily cell records or something.

    Oh, I don't blame you at all.  I just don't think what you are asking with a worthwhile venture.  Divorce him, confront him, or whatever it is you want to do.  To call his work and ask for his cell records to me doesn't sound like it's going to do anything but make it all worse.

    By the same token he can get a divorce just because he wants one.

    Trust your instincts. Since you already don't trust him and he's talking about leaving, what more proof do you need of his dishonesty?

    I totally agree with you!

    However, if she wants alimony?

    Trashing him at his job, not great idea right?

    Let him work himself silly and pay his alimony

    In my littel humble opinion

    don't mess with his job

    Just take him on in court

    Just my opinion of course!

    I have been a stay at home mom for 12 years so yes, I will get alimony.  He wants split custody and I have no job.  It has been several years since his affair.  He is telling me he is not contacted her since I found out, but I have to know....it will be easier for me to let go if I know the truth.

    This is a non legal dilemma. If you want proof he has not contacted this woman, then ask him for the phone bill and records. If he has nothing to hide he will show them to you. How can you tell who he texts just by the bill? My Sprint bill just has the total number of messages. This is the only affair you know about. Do you really think he will stop at one?

    What else he may or may not be doing is not really relevant if you seek a no fault divorce.  True--adultry may be an issue if you want to make it one--but I'm not sure it helps you....

    The fact that you have been sitting at home for a decade is by itself not an assurance of lifetime alimony--it may get you some alimony for some time to reinvigorate your job market skills--I doubt the kids need you at home 100% of time for diaper changes at this stage--so take a careful look at your re- employment prospects --you may need them..

    My children are well beyond diaper days.....they are 11 and 8.  I have been trying for 2 years to find employment that is PT so I can be a mother and have a career again.  So don't judge with out knowing all the facts.

    My job was to take care of them when they were here.  Now in school FT both of them I am trying my best to get a job.  You know how hard it is in today's economy.  I will not sacfrice what I have done for 12 years and work FT. My children come first period!!!!
