She very quickly made it difficult for me to work and I complained to staff psych. After that I was demoted. I left the organization after the demotion and subsequent transfer where I was subject to hyper supervision, etc., lied to about my employment status, etc. I had complained to our internal affairs office who found that my demotion was likely causal to my complaint to the staff pscych, but they just tried to cover the *** of the employer and did nothing to help me. Sooo..I went to the EEOC. The EEOC officer told me she had known the internal affairs people for a number of years and told me that the time limit to file a complaint had passed. I pulled out my calendar andstarted to tally up the days and while I was doing that, the EEOC officer changed her mind and said I could file a complaint, but that I had no grounds and started to berate me. EEOC tried to talk me out of putting sexual harassment in the complaint, then she started to go through my email evidence and suddenly changed her mind. Said EEOC could write a demand letter for me instead of a lawyer and it looked like a conspiracy. EEOC took my emails and some documents into the back to make copies and did not return the email that I had sent to HR telling them I wanted to file a complaint against the supervisor (dated just prior to my demotion). I didn't realize it was taken until I got home and they deny having it. This was 6 months ago and I've heard nothing from them. I was going to complain to the main office, but don't know if it will do any good. I don't want my name in the paper, so have not filed a law suit, but I don't like that the EEOC tried to keep me from filing and destroyed evidence as I am sure I'm not the only one...
Is this considered sexual harassement

I am wondering if this would be considered sexual harassment by my boss. I will give a couple quick incidences.
After
an employee brought in a doctors note with "nothing in vagina for two
weeks" he joked about it to other employees and even sent emails out to
the other management with Vagina as the subject and in the body it just
said nothing in vagina 2 weeks!!!. As his assistant I am the only girl
on the list that got it but it made me very uncomfortable.
Second his wife was having to have a vaginal hysterectomy for cervical
cancer. Not only did he make many crude explicit jokes about it he sat
one day and built her vagina and reproductive system out of office
supplies and sat and showed a bunch of guys exactly how they were going
to do her surgery, Sticking stuff in and out of the fake "vagina" I was
the only woman in the office and was horribly embarrassed and
uncomfortable so I just acted as if I didn't really know what was going
on.
He is well liked by management and I dont want to risk my position by
saying something because I think they will just brush it under the rug.

There is also always sex talk, dirty jokes crude comments ect. Any advice would be greatly appreciated
Thank you
Kim

Racial and Sexual Harassment

My Son has been racially and sexually harassed at his job by a boss. He would make terrible racial jokes about my son, and has even tried to touch him inappropriately, or tried to "accidently" bump into him. He would make these racial jokes in front of others and in front of my son's girlfriend. My Son complained to his bosses's manager. Now they are trying to fire my son. After my son complained, one of the "higher ups" told an associate that my son's job will soon be open, and to tell your friends to apply. We are going to file a complaint with the EEOC. They have been writing my son up for the littlest things. Now I need to know, should we file suit. I am also going to call corporate and complain. This company is [name removed], and I refuse to let them off the hook. Please tell us how to handle this. Everything below I experienced with an employer.

Surprise meetings are called by the boss with no results other than further humiliation.

I constantly felt agitated and anxious, experiencing a sense of doom, waiting for bad things to happen due to the ongoing harrassment from my Sergeant.

No matter what I do, I was never left alone to do my job without interference.

Sergeant tried to instigate an argument with me regarding overtime on Monday 2/15/2010.

I felt shocked when accused of incompetence despite a history of objective excellence.

Offensive conduct/behavior by the Sergeant. (including nonverbal) which were hostile, humiliating or intimidating.

Work interference — sabotage — which prevents work from getting done.

My work status was threaten by supervisor.

Giving impossible deadlines, overwork and undue pressures.

Undermining and demeaning standard of work. Constantly reminding me of my previous mistakes.

Sergeant constantly declared me as "insubordinate" for failing to follow arbitrary commands.

Sergeant would threw tantrums on several occasions when she is upset. (Hostile environment)

I was even ordered to participate to sing Karaoke, if not, I would be subject for insubordination. Note: (Abuse of authority and violation of Policy Prohibited Actions)

Sergeant harshly and constantly having a different standard towards me.

I was ordered to draft a report that was not even my case.

I classified a report as "Duty Upon Striking" which had witness information, statement, and a detailed report. Sergeant instructed me to destroy the witness information and statement and then she changed the title of the report with my signature.

Sergeant made up her own rules on the fly that even she/he did not follow. Example: Key handling procedures, being honest, ordering officers to work on administrative projects (her job).

I was falsely accused of taking orders from a non department manager and not consulting with my Sergeant first. I was then ordered not to communicate with the manager. I was the only officer not allowed to brief the manager of campus issues. (Singled Out)

I called my previous Sergeants many times for assistance of what to do and how to handle the hostility I was experiencing. None were helpful other than they all told me to continue follow orders.

January 2010 through May 2010 I was constantly harassed and Bullied by a Sergeant. Even the administration personnel notice I was treated unfairly.

I was warned by several administration employees and a non department manager to be careful with my department supervisor(s) Basically; I received an impression that they were out to get me.

I requested for a transfer to another campus after I filed a complaint against my Sergeant. The Lieutenant immediately denied my request. I was told that my request would make it harder for him and to try to give it a chance to work out my differences with my Sergeant. I felt that the Lieutenant did not take my case seriously. I felt that he did not responded appropriately. I suffered extreme anxiety and stress for 5 months.

In April 2010 and May 2010 I had received criticism 3 different times from my Sergeant about my writing skills. She stated that it is my Hispanic background contributing to my writing flaws. (Racial discrimination)

Sometime in April or May 2009 at NRG there was information by another student that there were two individuals in a specific vehicle with license plate information that they were smoking marijuana. I located the vehicle after the driver made a moving violation. Upon questioning the driver and passenger the presence of marijuana was noticed inside the vehicle. The two individuals Miranda rights were given. The driver and passenger admitted smoking and having possession of marijuana. The two individuals with the paraphernalia were escorted to the police office for further process. Sgt at that time ridiculed me and instructed me to destroy the evidence and to let the two individuals go and that I had no grounds making a stop. No information was obtained on the two individuals, no incident number was generated and no report was written (Cover Up instructed by Sergeant). Note: This is a hostile and stressful environment. This is a direct violation of the Clery Act. Also, if I did not comply with the intructions I would be written up for insubordination.

Whenever I voiced a grievance about my turn-around schedule and asked for a fairer schedule. Sergeant responded with humor saying that I need a “Woman’s Tampon”. (Basically saying, I’m whining like a woman and get a tampon.)

I and several officers have witness inconsistency procedures given by police department management. When Officers question procedures for clarification they are subject for insubordination. (Officers are set-up for failure and generates a Hostile environment).

I and several officers dealt with crime related incidents, but upper management later ordered us to change some criminal reports to an incident reports only. Note: This is a direct violation of the Clery Act. The public, staff, and students are not receiving accurate open records.

Double standards practices

June 28, 2010 Lieutenant filed a complaint against me on behalf of another employee who personally did not file a complaint. The department management failed to be objective and fair so that I can have a proper response. I was already judged and was told that I had no chance of winning the accusation and I was pressured to resign.

NOTE: November and December of 2008 during my probation period I was held back 15 to 20 minutes after my shift has ended 3 or 4 times a week for over a month. I began to file overtime weekly timesheets and they were denied.

Authority abuse (Basically we are trained to shut-up and do as your told.) I refused to be treated like this and I refused to participate in a dishonest department.

I had to sign an agreement in order to recieve a F5 Honorable discharge as long as I don't file a complaint againts my employer..

My character was tarnish throughout the department.

Allegations of an alleged inappropriate physical relationship with this woman were made prior to the primary by two men, but were never really substantiated. The woman candidate is married. All of this brings me to my question regarding a hostile work environment.

During a staff meeting that occurred after this woman had won the nomination, remarks that I considered to be offensive were openly being made about this woman. The men in this meeting were making vulgar comments about this woman such as saying that she had scr*wed so and so in order to obtain his backing. (A male candidate that didn't make it to the runoff election had publicly endorsed her.) It was also said that she must have scr*wed others in order to obtain certain achievements, etc. All of the men did not make these particular comments, but the ones that did not personally make them, were laughing when the others did. Incidentally, I was the only female at this meeting. The six men that were present are my co-workers. I openly supported this woman and they knew this. All of this occurred at the end of our staff meeting and I think that some of this was being said to goad a response from me. I did tell that them I didn't believe the allegations that were made prior to the election about this woman and that I didn't think that they should be making such comments about a woman that they did not even know. I also told them that I considered their remarks highly sexist.

I have been bothered by the remarks that were made at this meeting ever since. I have lost all of the respect that I formerly had for my male coworkers. I feel and rightly so, that the same type of comments would not have been made about a male candidate and even though none of the comments were directed at me personally, I feel that they were gender biased. The woman that they were making these comments about is also very attractive and it's just my opinion, but I don't think that they would have been making those vulgar comments about a less attractive woman.

The meeting was held over two weeks ago, but I am still mad about it. Everyone has a mother. If you are here, a woman gave birth to you. I feel that no man should make the type of comments that I heard, about any woman, specifically a woman that he does not personally know. You would not want those things said about your mother, so you shouldn't be saying it about someone else's mother. I also feel that any man that has a wife, daughter, or sister, and laughs or remains quite when other men are making those comments about a woman, is as guilty at the ones that are saying it by his seeming compliance.

Can't you tell that I'm still upset about this. At the time, I felt like I was in a boys high school locker room, but it was in our weekly staff meeting. All of the men are over 40 and some are over 50. I am so appalled by their behavior that I'm having trouble carrying on normal everyday conversations with them. Do men ever grow up? I expected better behavior from these older men, but are my expectations too high?

We had another staff meeting today and at the end of the meeting one of them tried to start up a conversation about the aforementioned female candidate again. I told him that if he knew what was good for him that he should drop it, which he did after our team manager told him to.

Incidentally, our manager was one of the ones making the worst comments in the first staff meeting. I used to enjoy working for the guy. But not any more.

Is the stuff that went on in our staff meeting considered to be a hostile work environment? It sure feels that way to me. I don't plan on pursuing this any further. Elections are coming up in November, so this type of talk is likely to start up again. I just want to know if this is covered under a hostile work environment or not, so that I can threaten them with it to make them shut up.

I'm sad and disturbed by all of this, because I used to think they were a great bunch of guys.

wrongfull termination or EEOC case

My daughter's boss exposed her breasts 3 times the other night at work. My daughter raised her hands and said "this is uncomfortable" and left, it was after hours and her workplace (resterant) was closed. The next day she was terminated for poor performance, she mis-rang an item on the register for a customer. The customer did not complain, the mis-rung item was corrected, the meal was not comp'ed to the customer. The same manager that exposed her boobs to my daughter was the one that fired her. Is this an EEOC sexual case or wrongful termination. Does she have any recourse?

When I got to work today, my main boss told me (even though she was not offended by it) that she had to document the "lewd act" for legal reasons in case it happens again. Can she legally document this and put it in my employee file since the text message didn't happen on company time and none of us were at work and it was all on personal phones (none of which were provided by the company we work for)?

I even told her I didn't know what happened and how she got the photo since I didn't send it to her in the first place, but I still had to sign her statement documenting it. She didn't really give me a choice and I even said "I guess there is nothing I can do, I have to sign this." Any insights on this matter would be great as I feel this was not necessary to do.

Sneaky Rep

I went to my union rep to complain about a male coworker harassing me. He advised me there could be reprecussions on me because I had treated the harasser unprofessionally in return (i.e. telling him to eff off and leave me alone). My rep did not want to discuss the case in the workplace and kept taking me out for lunch for 'privacy'. We decided me not pursuing this was the best course of action. We became friends. He was getting divorced soon. He wanted to start dating. I agreed as he gave me a very credible story including all his free time, an online blog documenting his horrible wife and discussing how we could go to HR about us having a relationship. I found out none of what he was telling me was true. I have documentation in which he states he falsified this information, but not much of the information itself as he knew what not to put in electronic communication. I also have documentation stating he was sending my emails to another male coworker. For what reasons? I do not know. Seeing as most of this happened outside the workplace, and did not affect my performance, does this still fall under workplace policy? The first harasser was someone I had previously dated years before and I feel the information I gave the rep was used to deveive me.

Not sure if Sexual Harassment or Not

Need help with this one.

Dated a guy for 1 year and did IT consulting work for him. Over 1 year ago he offered me a full time position with his company (over 40 employees) as his CIO and reporting directly to him. Great job, he's told me that he's so glad he brought me on board and what great work I do. I have this in many emails etc. from him both professional email and personal account email as well.

We had been "dating" on and off agin during this time and kept it out of work. My opinion it's no one's business but ours and he is the boss and can do what he wants as well. I totally respect that.

This past weekend he decided he did not want to date anymore however my work was valuable and since we did work together well and the entire company loves me....my job was secure. I too have this in writing both on corporate email and sent to my personal accounts as well from him.

Yesterday I walked into my CFO's office. Only then I saw him against the wall (hidden) and then realized they were talking. After seeing this, I quickly said "Excuse me" as I didn't mean to inturrupt and quickly left.

This morning I come in to an email on my corporate account from him (nothing face to face) that stated

"You don't know what respect for me looks like. I've never demanded it, only thought you might be capable. Apparently you can't recognize what everyone sees and will eventually strip me of everything I have.

Please, just find another job somewhere. You will never be able to demonstrate respect for me and I am not going to tolerate being treated like the village idiot.

I am in so much pain over all that I have gone through and The one person who supposed to care for me over anyone else, treats me in a way that would make an enemy shrivel. I'm done with it. Report to Susan, give me at least a week before you even talk to me.

You have your job, please find your way to another one in 6 months. And just leave me alone. It hurts to even hear about you or be around you. I have lived for two years without any compassion or concern with someone so worried about their own feelings they can't reach out to another Human being with any decency.

Please don't write, just leave me the hell alone and make some preparation to get this piano out of my house."

So, even as I have mail stating my job is secure and he's told me time and time again how valuable I am (to other managers too)...I feel I am being let go because he no longer wishes a personal relationship with me and is obviously angry with me about this and feels disrespected.

I am in a very economically depressed area and have been looking for other employment for a few months now however is this considered harassment and does he have the right to demand I "move on" because his feelings are hurt?

Everything in the company handbook and employee procedure manual describe that harassment will not be tolorated.

I have always recieved raving reviews for all my past employers and never had an issue such as this. YES - dating the "boss" isn't the best idea however dating before and working together has been wonderful. The company saw that as well and respected me as my own person for the job I do and provide them.

I now (as of today) only by this email's message am reporting to the CFO and not him anymore. I don't have a problem with that and I do like my job and those here....I think he's making an example of me because things didn't work out. I have no ill will towards him however do feel a rock in my stomach that he's hurt.

I am continuing to do my job to the best of my abilities and will continue to be loyal as always to the Company as well.

If he fires me...do I have a leg to stand on? At least Cobra or something?

Long story short, I worked with an older gentleman many years ago at a bank, he is married and so am I. He would send me emails almost daily stating how pretty I looked that day etc etc..I ignored them at the time because I thought they were harmless. Even after fellow employees stated they thought he had a crush on me, I didnt think anything of it. Fast forward in time..I leave the company and go work somewhere else..he emails me and tells me they are closing the company down do I have any openings where I am yada yada...I get him a job where I currently work in a different dept. The emails start up again, same mo as before you look lovely today etc but now they are a little more aggressive , stating "if I werent married and 15 years younger you would be in trouble! " I always replied , thank you , very sweet of you to say , trying to keep it lighthearted and not too much merit. Well he gets transferred to my dept. I notice he would get in these "moods" where he was visibily aggitated if I were to talk to another male employee rather than him or not include him in our conversation or whatever. The emails stopped..I thought problem solved right? No! A few months later I am informed he was to become my boss! After that this man has done everything in his power to make my life a living hell and to get me fired! He watched me wherever I went , he would stare at me constantly. He would accuse me of being on personal calls when I wasnt, he would blow up at me and be extremely sarcastic anytime I had to approach him with a problem or a question and this behavior was noticed by several people in the building . I went to his supervisor at the time several times to complain about his outuburst and his downright hostile behavior towards me (as well as some other women in the office) he said he would take care of it..then it would die down for a few weeks and right back to where he was before . His supervisor left and a new guy came in a few months ago. Well I was written up by my boss for tardiness, personal calls and internet usage..(all behavior that is allowed for my male coworkers but I am called out on it) I didnt say anything other than i will correct the behavior asap and I did. No more lates , no calls at all , and no internet usage accept for what my job calls for..a week later I was moving my email device from my desk to my purse (it was off and getting in my way) he comes behind me and yells "Get off the phone!! " it made me literally jump ..I tried to explain to him it was not a phone nor was I doing anything and he cut me off and yelled you're not doing work are you ?? and stormed off..that in itself was not such a big deal..but after years of dealing with being watched, stalked, yelled at , harrassed etc..I guess it took its toll ..the tears just started coming and it would not stop. I went to the new boss and told him everything. He put me in touch with hr and we had a meeting and I gave them my statement along with a copy of a few of the emails he had sent me that were sexually explicit , copies of emails between several women in the office expressing the same concerns about the same manager and a witness to the latest outburst and how she feels he has a problem with women in general. That was a month ago! Nothinig has been done and every day I still come to work with this man sitting 30 feet away from me scowling at me through the cubicles! It's driving me crazy! Every time I ask what is being done I get the same response "we are still investigating" What else is there to investigate? I provided written , and verbal proof as well as witnesses! Is there a reasonable amount of time a company has to address a complaint of sexual harrasement and hostile environment ? I appreciate your responses . Thanks

Sexual Harassment

Hi, I am the only female who works on our dock. I have been going through hell. I am a freight inspector at a major trucking firm and the dock employees who don't want me out there, make my job harder than it has to be. Recently, they started a safety program at work. We are all required to change the number of days we have successfully worked without injury.
Tonight, I was told by a dock worker that someone changed my name on the board, and put a derogatory remark after it along with changing my days of not being hurt to 666.

I want to take action. I filed a complaint with the local police department. I also took a picture of the comment and what was wrote. I sent it to my email and it's not required to be detached as the pictures just show up in the email. (I was told that this would be a good idea, since they're playing games with me)

I sent a copy to my boss with a letter telling him I was very upset over it, and want those who did it held accountable. I don't think they're going to say who did it. It made me feel horrible. I have a hard enough time trying to do this job with the other petty games they play, like moving freight on me, or loading it even though they know it's due for an inspection.
I think the guys on the dock want to make me quit and I refuse, but they stepped over the line this time.

I don't have the time to take off to go to the Human Rights commission, I think it's a waste of time, I want to talk to a real lawyer who can tell me if I have a case or not. I am a single mom who has no way to just take off whenever I want.

I've been with this company for almost 7 years now and was promoted from part time *even though I worked full time hours constantly from the day I was hired and got no benefits that the full time people get*

How do I persue this, and find a good lawyer without getting screwed? I don't have the money to pay a lawyer but if I let it go, they'll just keep doing things and I don't want to let it go, because I don't think I can take much more of this.

Any suggestions?

Wrongfully accused of sexual harassment?

Recently I was accused of sexual harassment. My employer brought me in and stated that because I sent a text message 2 months ago, even though we haven't spoken since then, to this girl I was dating 4 or 5 months prior, which at the time she felt comfortable and welcomed behavior of the sexual sort, now finds it unacceptable.

My text message, which I now terribly regret, took place in a conversation between a customer and I, when the girl walked passed us both, and the customer checked her out and asked me if I would like to "hit that", or have sex with her. I, of course said yes, and thinking that it was a compliment to her, I would send that to her. 2 months later she files a complaint about that text. Also, keep in mind, that we have not spoken after that 2 month period as she works on the floor and I work in the stockroom where I would rarely if ever see her. When we were dating, she had a boyfriend, and later on into the relationship, which was about 3 or 4 weeks, I confronted her about it, which she did not like, and since then she has been hostile, with a few exceptions.

There is more incidents that have occured between the time we were dating and the time I sent the text, that would suggest her character and motives. I will be happy to list if it will help my case. To me, it seems that she is looking for revenge after me confronting her about her suggestive behavior that not only took place in our workplace, but her second job at which I was present.

Am I being falsely accused, if not, is there some kind of claus that deals with 2 month delay of filing the complaint? I know she has malevolent intentions as if it really had been an issue of sexual harassment, she would have filed it the day i sent the text, but instead waited 2 months. Is there a way to protect myself from a situation like this?

NEED HELP FAST !

I went to work on may 11th only to be called into the office by my fitness club manager and told " someone " made a complaint on me for a comment(s) made in a sexual nature and or a racist nature. they then suspended me and wouldnt tell me what the comments were that were supposedly made.

I embace you". From time to time he would ask me if I was seeing someone. I let him know I was, and when things ended between me and my boyfriend my team mete said "If you were my woman I would treat you right".

In August 2009 I caught my team mate off guard and ended all personal interaction. For one he tried to turn me against all my other co-workers, and I felt like he was trying to isolate me. He would talk about all other co-workers like they are dogs. Even going as far as to tell me what perscriptions one of them was taking, and how she was an addict. He said the worse things. I needed to seperate myself from him.

I knew that he wasn't going to stop pursing me so I called a meeting with him and my supervisor, and told her to witness that I had asked him to please respect my wishes, and undertand we are no longer going to have small talk at work, but a strictly business professional relationship. I could have never forseen what would happen next.

My team mate continued to place phone calls to my cell phone after work. Begging me to work things out. What was weird is we never had anything really except for working relationship. I didn't understand why he felt this way. One 9/18/09 and on another occasion after (which my phone records will show) My team mate called me and stated on my answering machine, "I am in love with you, I love you, I love you. This has gone on too long, we need to fix this etc." he did this twice. I ignored him.

The plott thickens. I came into work once day, after ending our so called frienship, and Human Resources were waiting to interview me, can you believe they were there to interview ME in the conference room. They stated that my team mate told them that I carry a knife in my purse, and that six months ago I told him I was going to cut another co-workers throat with it. I was appauled. I went and got my purse, pulled out my bible first (so I could find the knife at the bottom), then showed them the knife that my father gave me to carry at all times. I let them know that my team mate saw my knife on my desk one day, because I used it to cut fruit at my desk. I denied all other allegations, because they weren't true and it was evident that my team mate had become an OBSESSED LIAR. I was suspended for the day. Not for the threat which was dismissed as hear say, but for having a knife. Later I addressed my manager with a Union Steward for the knifes with blades twice the size of mine housed in an unlocked drawer in the suites kitchen. I have pictures of that knife. Doube standard!

This was clear retaliation on my team mates part. Angry that I rejected him, and did not want to be his friend. A couple weeks later, I was called in to speak with HR again. My team mate stated that I passed him in the suit and "either" mouthed or stated "your dead", he claims he doesn't recall which. I never said such a think, and realized that he was trying to get me fired. That same day my team mate was found looping my favorite song (a love song) at his desk from 9:00am to 1:15pm non-stop. I had my supervisor and a Union Steward whitness this. Although they found his behavior of looping the song "You and I" disturbing, nothing was done. Even the office security said he has said things to them about me that were inapproriate.

I have since filed an EEOC, the EEOC officer stated that she doesn't know what was on the other side of those text messages that he sent me. So I forwarded her every text messaged in my phone between me and him. She has not responded. She told me she will consider only the things he has done since I ended our aquintance. I am so stressed out. I have to work with this person everyday. Aside from the false accusations I have faced because of his lies. I am seriously considering going out on stress. He has sent me rude emails since I ended our aquantance, and since the meeting I called with our supervisor, even the EEOC officer admits they were rude. Now, I am to wait 30 days for a written decision mailed to my home from the EEOC officer. Why didn't they fire him on the spot. Do I have a lawsuit?

employee sexually harassing a supervisor/manager

what are the legal ramifications of a supervisor accusing an employee of sexual harassment

sexual harassment case.

An co worker has filed a sexual harassment case against me and is trying me and the company stating i told her" In fear of retaliation , she has confided in me to request help. She also verbally warned all other female employees of the occurance.

[the owner] grabs the wait staff' (all white female) in a lude manner, touching their inner thigh's by means of grabbing from behind and reaching between the legs. During many of these occurences there are customers and other employees present. I witnessed [name removed] , owner of the restaurant [name removed] grab a waitress by the upper rear portion of the leg, and laugh. The Waitress looked at me in horror . I encouraged her to file a complaint and she replied , "I'll lose my job".

Texas Penal Code:

Sec. 21.08
. INDECENT EXPOSURE. (a) A person commits an offense if he exposes his anus or any part of his genitals with intent to arouse or gratify the sexual desire of any person, and he is reckless about whether another is present who will be offended or alarmed by his act.

Sexual assault is usually considered a more serious crime and may be classified as a felony,

Sexual Harassment

An employer may be liable to an employee for instances of "sexual harassment" which can include unwelcome sexual advances, conduct or other physical or verbal acts of a sexual nature, which occur in the workplace. The following conduct is generally considered sexual harassment.

(1) Direct sexual conduct--an employer makes sexual advances or statements

(2) "Quid pro quo" - job-related benefits are offered in exchange for sexual conduct

(3)Hostile work environment--an employer maintains an overly sexual work environment

Non-Compliance of Federal Wage Laws .

Not one single hour of my overtime has been paid . Some employees are working strait double shifts without recieving proper compensation. Payroll checks bounce due to insuffucient bank funds. Employees are recieving cash from the till and being asked to endorse their payroll checks due to insufficient bank funds. On one occasion I requested a paystub and was reprimanded verbally. Payday for me was cash in an envelope with no record or tax information included. Sometimes, I would have to wait for the next day's till to recieve my weeks pay.

The [name removed] restaurant reports exactly the same amount each shift for each waitress no matter how much is earned. An overnight waitress caclulated she earned an average of $3.13 per hour. Far below the Federal minimum wage.

Sec. 62.051.
MINIMUM WAGE. An employer shall pay to each employee the federal minimum wage under Section 6, Fair Labor Standards Act of 1938 (29 U.S.C. Section 206).

There are many claims that [name removed] restaurant is deducting money from paychecks weekly. This money is being deducted because the till count is short at the end of thier shift. Some waitresses refuses to work if the initial count shows them to be short at the start of the shift. Still they find ways to take their small $80.00 paycheck. One waitress works 7 nights a week because she only makes just over $3.00 per hour.

Sec. 61.018
. DEDUCTION FROM WAGES. An employer may not withhold or divert any part of an employee's wages unless the employer:

(1) is ordered to do so by a court of competent jurisdiction;

(2) is authorized to do so by state or federal law; or

(3) has written authorization from the employee to deduct part of the wages for a lawful purpose.

Pornography being displayed in the lounge to Employess and Customers by Owner/Manager of [name removed] Restaurant

I'm sure that City Officials would have a few choice words about this matter. Several witnesess to these occurances claim that [the owner] displays pornography to unwilling bystanders that includes employees and customers via laptop computer. The female employees felt very uncomfortable when a scene of a woman performing oral sex was called to their attention by [the owner] during a viewing of the pornography.

A known prostitute is currently employed at [name removed] Restaurant. According to several insiders, a customer caught a sexually transmitted disease from a prostitute during his visit at the [name removed] Restaurant. [the owner] could not deny these claims becuase he walked in on the sexual act as it was happening in the men's room. The infected husbands spouse threatened to alert the media and Local Law enforcement and demanded money to keep it quiet. The restaurant paid the angry spouse and deducted payments from the employee's weekly paycheck. The employee is still employed at the restaurant.

City Ordinance:

Sec. 36-2.
 Certain businesses and conduct prohibited.

(a) A person commits an offense if the person intentionally or knowingly operates or conducts any business in the city in an adult encounter parlor, escort agency, or adult modeling studio.(Code 1961, § 21.04.02; Ord. A suit may be initiated upon information received from private citizens or any law enforcement agency.

(Code 1961, § 21.04.27; Ord. No. 97-21, 6-3-1997; Ord. They claim that [name removed] Restaurant is not only racist , but verbally abusive and often use the racial word [racial slur removed]. I have heard this word very often while employed there, especially by [name removed]. In fact one was refered to as a [expletive removed] by [name removed] during a conversation at the employee table regarding an overnight black cook. Comments like "what do you expect out of a [racial slur] are a daily occurence. Having an African Amercian Sister , I was deeply offended by [name removed] remarks.

Important Facts:

99% of the full time wait and management staff are white , there are no Black cashiers, waiters, or any other publicly viewed positions.

99% of the kitchen staff are black and part time and are assigned to non public work stations. Dishwasher , prepcook, Cook.

Money Laundering / Embezzlement / Fraud

Co-owner [name removed] fraudulantly records false profits. Below I will state provable motives. There are witnesess to these occurances. They claim [name removed] will pocket a large sum of the till and report far less than actually earned.

(1) She fraudulantly recieved disability and continued to do so after gaining ownership of the restaurant. Built the financial structure using her spouse's name to facilitate this.

(2) Her lease agreement requires her to pay a percentage or adjustment if her said profit margin does not reach expectations. Therefore, she reports far less.

(3) Records fraudulant profit data to avoid Federal , State, and Local Taxes.

(5) A Recent promotion of an hourly waitress to General Manager resigned the position due to financial discrepencies. She was expected to sign off on financial reports she absolutly knew were fraudulant. 14 days after the promotion , the Mananger requested to be demoted for nopayment , and did not want any involvment in the fraud that was occuring.

Any thoughts or pearls of wisdom regarding this letter before i send it to everyone?
