Red Light Ticket

So last October I got pulled over for a failure to stop at a flashing red light. I got arrested on suspicion of DUI. I blew 0.00 in a breathalyzer and my drug test came back perfectly clean. I was wondering if a viable defense against the red light ticket would be that since the officer could not tell if I was intoxicated then how can not have made a mistake about the 3/4th stop at a red light. 107 people in Greene County, MO were arrested on DUI in October 2009 and 106 were charged so since I was the only one who was not charged I believe that this cop's mistake was a pretty big one so could it damage his competency/credibility. If it is not a good defense then I will plead no contest.

This was a case of profiling because the officer pulled me over leaving a college campus and his sergeant told me on the phone the next day that all College kids smoke dope and I would test positive, but I can't prove that.

Pacing Ticket Without Certificate of Calibration

I recently requested discovery for a speeding ticket of 83 in a 55 where the County Sheriff paced me in Oregon. From the discovery, I learned that the speedometer in the car had never been calibrated. The pacing car was 3 years old with 84,000 miles.

Without a calibration certificate, do I have a case or am I still going to get rung up by the judge?

So I was pulled over for going 70 in a 55 in Maryland, plus I had a recently expired license which, although renewed in my home state, I had yet to receive a new photocard. The officer takes my information, then two minutes later comes running back, gives me my stuff back, hands me a warning for driving with an expired license, and says he has to take off because of an emergency call. I did not receive a ticket for speeding or anything that memorialized the speeding violation.

Last week (about two weeks after the stop) I receive a Notice of Trial Date for October, saying I am summoned to appear for a trial for the charge of exceeding the speed limit, and saying if I don't contest, I can just pay the $90 fine.

Given that I live out of state, about three hours away, it is a huge inconvenience to take off work to attend this hearing. Is there anything in these facts that would make it worth my while to fight it? Is the protocol here legit? I thought the fact that I was given nothing at the time and heard nothing for two weeks would give me a good basis to challenge the violation, but I don't want to waste my time driving down there for a loser.

Thoughts?

Im Canadian -What happens if I ignore my U.S Speeding ticket

Hi All...

I was in the State of Nevada last week when I got a ticket, 80mph in a 70mph zone. The ticket states I was clocked at 92mph but reduced to 80mph.

Now that I am back home, im just wondering what happens if I ignore it? Will they really issue a warrant for my arrest for a traffic infraction? Is there anything they can do, considering we are neighbours? What if I go back to Nevada in a year?

Any thoughts would be appreciated.

Suspended Registration in citation while temp living in GA

I was in GA for 1 year while my wife was studying at Emory. The car was registered in California and we had valid GA insurance. However when the registration came up for renewal, CA DMV claimed that they did not have insurance on file, but they cashed the check for renewal fee. I sent them the GA policy which they rejected saying that I needed a California policy to renew. None of the insurance companies would issue me a California policy while the vehicle was physically located and driven in GA. I visited California and collected my mail in early 06/2009 and then went back to GA on 6/22 (hadn't opened the mail, but knew there was something from California DMV which I expected was the new registration and stickers. I was pulled over in Gwinett and cited for driving without registration. When I went back home and checked the letter, I became aware of this suspension and tried to get the things sorted out, even to the extent of trying to re-register in GA; which I could not do because GA motor vehicle person told me that I was a visitor and cannot register. I was to move back to California on 7/3 and the car was being shipped back on 7/2. Finally, after much haggling and pleading, my insurance company agreed to issue me a California policy while keeping the GA policy active for a few extra days. Everything was sorted out the very day the new policy got issued and registration came out of suspension on 6/26.

I called the Solicitor's office who told me the ticket was $700. I don't know what I should be doing and would really appreciate if some kind soul can provide some guidance. Is there a way to contest the ticket over mail? What effect would it have (if any) on my California license?

had mistaken my name 3 times

I understand that if a police officer mispelled your name is not enough cause to dismiss your case. But my situation is slightly a little bit different. He wrote my first name wrong my actall name is

o My name is Angel he wrote down De

o My middle name is Manuel he worte down Jesus

o My maiden name is De Jesus he wrote down Angel

o He didn't put my suffix and the only thing he got right was my last name

On top of that my driver license does not state the expiration date. On expiration it says military. Which it means that to verify that my license is not expired he must ask me for my military identification card and verify the expirattion date on that card. With that driver license I can keep it for as long as I want as soon as I am in the military service and have with my possesion an Military Identification. The police officer never verified my military identication card. Do you think this case can be dismissed if I decide to fight it.

Wrongful suspension in Hawaii

Hi everyone~

I am currently unable to renew my license (in the state of Washington) because I was told that Hawaii has suspended my ability to drive in the National Driver Database.

After 2 weeks of getting bounced from department to department on the phone I was finally told that my license was suspended due to an accident which occurred in 1980 in Honolulu.

I remember this accident - it was a tap on their rear bumper (5 mph bumper) and I gave them $300 to replace the bumper.

Hawaii now claims that because I did not carry insurance back in 1980 that I must post a $20,000 bond with them "in case I am ever sued" in order to get my driving privilidges restored. When I mentioned that it was absurd considering this occurred 30 years ago - and they told me there was no statute of limitations.

This is not the first time they have done this - I found my license suspended by them in 1998 for the same reason - but after 2 weeks of phone calls I finally got a supervisor to remove the suspension. Now someone has put the suspension back on my license and no one will discuss it with me.

After being bounced from department to department I was finally given the number for the department of Financial Responsibility. I tried for over a week to get through and always got either an error message or a fast beep. Finally I looked them up on the web and got a fax number and instructions to fax a written request.

Their response was a demand for the 20K bond with no option for rebuttal. I am currently in bankruptcy and there is no way I could post that bond.

I am thinking it's time to try and find a lawyer - except I can't pay for a lawyer so they would have to both be licensed in the State of Hawaii AND willing to take the case Pro Bono from an out of state client. So far I have had no luck with this. I am open to any and all advice.

Speeding Citation

Stopped for speeding, the officer said he had it on video and I asked several times to see the video evidence and he refused point blank to allow me to see it, his colleague turned up and he also said I could not see it. I thought in Colorado I had the right to see this video at the time of the offence, is that correct?. They also told me the speed gun would time out after 4 mins but at least 6 or 7 mins after the stop it still showed the disputed speed, as there was no time stamp on the gun I vehemently made it clear I thought it was a bogus reading. If am not allowed to see it at the time of the offence how do instigate a "discovery" to get copies of the video, officer's notes and maintenance records for any radar or laser equipment the officer used. I also believe I am entitled to the records relating to his booking out the laser and its calibration certificate which has to be current, what is current?

The reason I am incensed at this is he was in a side road and I was on the outside lane of two lanes and there was an SUV on my right which had just passed me. The video evidence would either prove or disprove my case.

If you receive a traffic citation (speeding) that has the wrong name, wrong driver's license number, wrong date of birth and is unsigned (the police officer did not sign it and did not ask the recipient to sign), is it still valid? Will it hold up in court?

Getting a Suspended License without knowledge thrown out

I had a suspended license for a ticket in Orlando, FL which I thought was paid. I moved to South Florida and I ended up getting pulled over and was issued a ticket for driving on a suspended license without knowledge.

After getting the ticket in south florida, I quickly corrected the issue by paying the Orlando, FL ticket in full and then got my D6 Satisfaction, then got my Reinstatement from the DMV, and also now have a new valid drivers license.

I have a court date today for a Hearing/Conference, I am wondering if the judge will throw out the ticket because I now have a Valid license. Or will I still have to pay the Driving on a Suspended License without Knowledge ticket? Is there anything I can say or do to help my chances of getting the ticket thrown out?

my husband received a ticket for not wearing his seatbelt, the officer was wrong, he was wearing his seatbelt and has 3 witnesses to state that fact.

the judge has scheduled him for a trial by jury, what happens at the pretrial? what happens if the officer doesn't show for court?

any info would really be appreciated.

Boise Idaho Reckless Driving claim by a fellow driver

My disabled friend was surrounded by 5 Garden City cop cars, While parked at the D&B parking lot at Glenwood and State St. He was forced to stand in the 102 degree sun, for a hour and a half ! ( his passengers were his 15 year old daughter, a 11 year old girl and a 10 year old girl). Also had to be outside of the car for 90 minutes ! While the Garden City Police Department tried to figure out just who in the hell was supposed to actually cite the driver. Based on a cell phone call from a HUMMER owner. after 88 minutes a Boise police man showed up to write a "non witness" citation for "reckless driving", The ticket states that the incident happened at Cole and West Park!! #1 I cannot find where Cole and West Park intersect. ( because they don't). #2 His Hummer's left side tires WERE over the center line near Cole/West Maxwell, My friend maintained his lane , wich forced Mr. Hummer over to his lane only. ( I feel Mr. Hummer didn't like being forced to drive in between the alotted lines) . and he knew if he touched my friends car he would have to pay for BOTH repairs! So It appears he just called 911, (cause when you waste $ 60,000 on a vehicle that is to big for the small streets and along comes the guy with common sense in an Impala SS, and forces you to drive correctly ! Your only option is to call the LAW and tell the operater, "You wasted 60k on a vehicle that very FEW people RESPECT!!!! I don't know where the jurisdiction starts and stops for (Boise/Garden City) . It's somewhere on Cole, Mountain View or Glenwood ? Apparently the witness had a patch on his left sleeve, Could have been a Boy scout troop leader for all I know! He told the Boise cop that he was in fear of an Impala SS, while he was driving his HUMMER. My friend NEVER crossed a line without signalling!, Never squeled a tire, Never hit anything or anyone. AND never exceeded the
speed limit!. He has from Aug. 11 to Aug 18 to show up at the Ada county courthouse, to act on the citation!!!! I told him to just stop in and plea NOT Guilty. Suggestions appreaciated.

Stopped at Stop Sign, Cited Anyway

I have been a professional driver on and off for about 30 years and for more than a million miles, with no accidents or citations. It's a long-time habit of mine to make full stops at stop signs.

I know the 4-way stop near my home in rural Missouri is frequently monitored by the local police and the county sheriff, and so I stop and "hang" a little longer there to assure that any observant officer sees that I have come to a full and complete stop. I have been through the intersection more than a dozen times while an officer was watching without incident. My vehicle is kept clean and is in proper legal and mechanical condition. I always wear a seatbelt.

Last night I made a "hanging" stop at the 4-way stop and proceeded (there was no other traffic in sight). The county sheriff pulled me over and said I didn't stop at the stop sign. Irritated that I had made an intentionally long stop that was obviously missed, I told the officer I made a full and complete stop. He then told me I blew right through it, which made me angry. I did not argue with him, and did not use profanity, but I strongly told him I did, in fact stop. He wrote the ticket and told me I could have my day in court. I thanked him and departed. I did not say anything else to him at any point -- but I wanted to!

It is my intention to contest the citation in court. My concern, and reason for writing, is to ask for some suggestions on how to best prepare my argument for the court. I do not want to exaggerate, and I will not lie. But I am absolutely, unequivocally certain I made a long stop. The officer is simply wrong about his assessment and citation.

What can or should I do to prepare for an intelligent, well-prepared argument in court?

TRAFFIC VIOLATION DRIVING ON A SUSPENDED LICENSE

I'm schedule to appear in a federal court for driving on suspended license. I have asylum and I would like to know if this would affect my immigration status. I don't know what to do I have been living in the US over 20 years. My chargers are up to 1 year in jail and 1,500 fine. I'm attending the second court date in upberdeen md. I'm just not sure what would be in overall with my immigration status. Please can you help me with any advice in what I should do.

Alright so I have spent countless hours trying to come up with a solution that is having a serious impact on my life.

About 7-8 years ago I received an array of traffic citations in 3 different states; California, Nevada, and New Jersey.

In California and Nevada, I received a speeding violation that I did not respond to thus resulting in FTA bench warrants being issued each respective county/state. About a year later I was arrested in New Jersey for driving on a suspended license. I did not appear in court for the original date on this citation either, although later I did turn myself in on the warrant, spent the day in jail and saw the judge. However I did not follow up on this matter after.

The problem I am running into now is that I am having a very difficult time finding work where I reside in Arizona. To make matters worse there is no public transportation here and I am on the verge of becoming homeless if I cannot find work.

This puts me in something of a catch-22 situation. I can’t work without a license, and I cannot pay the fines (around $10,000 worth including FTAs, and failure to provide insurance) without being able to work. For some time I was living in an area with public transportation and able to maintain a job that was suitable to cover only my living expenses leaving no additional monies to work to resolve this issue. I also tried to enlist in the Air Force and Navy, each telling me that I would need to clear those before I could.

What I have been looking for is a way to answer to the courts for these violations. I have already attempted to write them and ask for possible resolutions, each not responding to my written correspondence. I have also attempted to call each court, resulting only in offers to setup payment plans.

What I am asking here, as I cannot seem to find any information on the matter and cannot afford to hire an attorney is this:

Is it possible for me to have these cases transferred to the jurisdiction in which I currently reside and in turn be able to answer to the local court in hopes that I can work out a community service repayment and/or jail time to clear these concerns? I am very much unable to appear in person at any of these locations. If it is possible for me to have these cases transferred how would I go about doing this?

Last summer I was able to obtain a temporary license within the state of Arizona to complete an internship with a state government agency. However, that was a 6-month one time only deal, and as far as I am aware Arizona does not have the availability of a hardship license.

If I can transfer these cases I will gladly answer to the mistakes I made when I was young and wreckless. However if I cannot, I see no other real options except obtaining insurance, driving to look for work, and running the risk of getting into more trouble in order to survive.

Any advice or help would be more than greatly appreciated! Thanks in advance!

traffic ticket in michigan no authorization pending or codes

Yesterday I received a ticket for improper lane change (as written on the ticket). I was cited for a civil infraction on this. Since I'm from ohio, the police officer took my license (obv I could not pay bond on the spot..). I went to the court house this morning to try to pay the ticket but they didn't have my license in yet, so I'm going to try again tomorrow.

When I was looking at the ticket, I noticed there were no authorization pending or offense codes written down. The woman on the phone from the court house tried to explain "oh the officer just didn't press hard enough with the pen"... there's not a smudge anywhere, it's completley clean. Everything else on the ticket transfered just fine including the stamps... so what's the deal with that.

If you ask me, saying that defeats the purpose of carbon copy all together, how do I know the officer can't just adding things to the original copy then say "oh I didn't press hard enough with my pen to transfer to your copy".

So, what am I looking at as far as ticket price and points? Will there even be points? Should I try talking to the prosecutor tomorrow and explain the offense code thing and see if I can get it dropped? Any help is apprecited!

Hello, what does "submitted for dismissal" mean?

Hello everyone. Quick question, my daughter got a ticket in the mail a couple weeks after an accident. The ticket said to appear in court yesterday. When we got there, they had no record showing that we had to appear at all! The lady basically said to hang on to the ticket for a couple years, see if anything comes of it and don't worry about it.

That didn't sound right to me so I called the JP's office today and the guy there said the case had been "submitted to the district attorneys office for dissmissal" and I should "call back tomorrow and check on it; thank you and goodbye".

So my question is, what does this mean really? If a ticket is dissmissed does that mean it doesn't go on her driving record?

Driving with expired License, California

Please help me,

I am very scared, because yesterday I got pulled over by a very jerky motorcycle cop in Orange County because he saw me holding a cell phone in my hand.

I was not really using it, and then he asked for my license and registration. I was shocked because my license was expired, and I had not realized it, because I hoped the DMV was sending my renewal notice in the mail, as they did with my registration.

He told me that my car could have been towed, and I started to panic, and then I was crying very badly, because I have an anxiety disorder. I think he felt bad, so he dismissed the cell phone violation, but ticketed me for the license, and told me to park the car and get someone else to pick me up.

My fear is I dont know what will happen, the cop implied I could just correct the violation, but according to the ticket that is not so..

Also, this is a misdemeanor, and that scares me because I don't want to go to jail, and I am poor, I can't afford a severe penalty, I dont know what to do.

I have already fixed the license renewal with the DMV, but I can't get any information over the phone with the courts about the fine. They just told me to wait for the curtesy notice.

I am not an irresponsible driver, so this is very frightening to me. I read you can go to jail and pay over $1000 for this, thats too much for me to swallow.

TRAFFIC CITATION

I received a traffic citation that states Inproper Lane Use. Here is what happened -

I just got out of work. I took the on ramp to the highway going North. There are 2 lanes before actually getting on the highway. I first merged from the 1st lane which was an off ramp to Pearl Street, to the 2nd lane which was an off ramp to Hwy 196. I put on my binker and waited because traffic was at a stop. A ar went forward and created a space of 1 1/2 car lengths so I proceeded to merge onto the hywy. The car which had at that time not moved came forward and hit me. I received the ticket and points on my license. I don't understand why the officer said Inproper lane use when I wasn't using the lane inproper at all. Is this something I should fight? The ticket is $171.00, which is an awful lot to me and I don't feel that I did anything inapropriate to get the ticket. The other car hit me when I was signaling and traffic was backed up. Thank you!

Recently I received a letter in the mail notifying me that my drivers license had been suspended. I had not gotten and tickets in the counties that the ticket were issued and found out that my brother used my ss# when he got stopped for a traffic violation on two different occasions. Is there any way that i can have the violations removed from my record, and him not have to go to jail. If he does have to go to jail how much time could he possibly get with no priors besides a couple of tickets and small things no felonies.

Leaving Scene of an accident/ Hit and Run in PA

I recently hit a wooden gazebo at a outdoor furniture store while backing up after turning around after realizing I was headed in the wrong direction. I barely hit the gazebo with my bumper causing no damage to my car or the gazebo. Then as I started to pull away I saw three employees (witnesses I assume) of the store yelling and waving in my mirror at me and instinctively stopped for about ten seconds then panicked sped off and took a zigzag route to get away from them if they tried to chase me. I don't know if they got my plate number or a description of me but surely got a description of my car down to make, model(maybe), and color.

If they got my plate number, what could happen if they decided to call the police? Would I get arrested, a courtdate/citation...? What charges could be brought against me and what would be the penalties? Would I need a lawyer?

Driving without a 21 year old and speeding ticket - Atlanta

About a week and a half ago I was pulled over for going 83 in a 65mph zone. My friend who is 19 and a licensed driver was in the car with me at the time I was pulled over. I was driving with my CP license so the officer wrote me a ticket for driving without a licensed 21 year old. The next day I actually got my license. Is there anything I can do in effort to reduce the ticket or even get rid of it?

ticket for failure to yeild to pedestrain in crosswalk -help

Hello,

Recently i was sited for failure to yeild to pedestrain in crosswalk. Pedestrain was on his bicycle and had minor scraches in his legs. Ambulance didn't came.

Police officer wrote an accident report and wrote everything agaist me. I am not satified with the accident report and i talked to the accidnet office regarding to change in the report. Later on I found that accident report can be changed only by the officer and who is currently on medical disablity for long time. Officer wouldn't appear in court. However the pedestrain came to the court and i have next court.

What can be done in this situation to avoid traffic citation ?

What's the wrost thing if i pled guilt ?? Thanks for the help.

New hampshire speeding ticket.

I was driving to NH the other day and i was hit with a radar gun doing 85 in a 55. The Trooper bumped the ticket down to 85 in a 65 on the spot but i believe that i can fight it because of circumstances. I had a car coming up on me fast in my lane and i needed to get by a truck on my right before i could shift lanes. If i fight this will i be heard or does circumstance not matter? my last question is if i lose will i end up paying over a grand in court fees? i have searched for them but cant figure out exact price.
