The cost for the total project was $6000, and we signed a contract for the developer to be paid 50% upfront ($3000). The last half of the fee would be paid when the project is finished. In the contract it reads, &amp;quot;the web design company will take all reasonable actions to complete project by December 20, 2009. &amp;quot; I have not seen any work from the project and I have not heard from the web developer since January 18, 2010 in which he stated, &amp;ldquo;I will be back from South America at the end of the month and will provide you with a realistic timeline that will enable us to get this site up and running.&amp;rdquo; I have sent several e-mails since that e-mail, called their phone number minimum 20 times, and left several voicemails and still have not heard from the developer.&lt;/p&gt;
&lt;p&gt;I finally received a response on 7/23/2010 after I contacted two of the web developers friends to make them aware of the situation I am in. I then immediately heard from back the web developer e-mail within 2 hours of sending a e-mail. However the web developer did not respond to me, it was his wife. All she did was apologize on behalf of her husband and continue to feed me excuses that her husband has &amp;quot;undergone a very traumatic experience with the loss of several of his family members.&amp;quot;&lt;/p&gt;
&lt;p&gt;I warned her that I need to hear back from her husband before August 25 or else I would have to pursue legal actions, and she followed that by he will be back in the country before then and will get in contact with me.&lt;/p&gt;
&lt;p&gt;This all SCREAMS scam to me. And I had a strange feeling in the back of my head PRIOR to sending him the money that it was a scam but I was so caught up in wanting to get this project done by a professional that I ignored my thoughts.&lt;/p&gt;
&lt;p&gt;First I directly deposited the $3000 to their bank account, and yes I still have the receipt. That was a major NO NO, and I knew that at the time but since he appeared to be legit and has created some good projects I thought nothing of it. You should never directly deposit money into ANYONE account and I knew that. We were in contact for 2 months after depositing money, he spoke to me nearly everyday on MSN. However we never talked about the project and if I ever asked about it he would say there&amp;#39;s nothing to show at the moment because he is working on the coding. But he would contact me everyday to have a regular chit chat.&lt;/p&gt;
&lt;p&gt;The MAJOR issue I have is that we signed a contract but I no longer have the signed version of the contract! He sent me his signed version of the contract via MSN, however my computer lost all data on it while doing a upgrade to Windows 7. So now all I have is the contract and agreement with no signatures. I also no longer have the MSN conversations. All I have is the contract with no signatures, e-mail communication, and receipt of bank deposit.&lt;/p&gt;
&lt;p&gt;I would like to have the money refunded to me. We have provided them with all our digital data as they have requested on time.&lt;/p&gt;
&lt;p&gt;Two weeks before trial they have provided us with black and white photo copies of the actual CDs we have requested&amp;nbsp;printed on copy paper along with over 180 pages of poorly printed digital images and properties folders that have been digitally cut and paste to each page of paper.&lt;/p&gt;
&lt;p&gt;We have no way of knowing if the paper exhibits they have provided are authentic since they apparently will not provide us with the CDs as we requested, and now the trial is only days away.&lt;/p&gt;
&lt;p&gt;The defendants spent a great deal of time creating the 180 pages of cut and paste digital data on copy paper, when they could have produced the CDs in a matter of minutes back during the discovery process.&lt;/p&gt;
&lt;p&gt;I find their latest actions very insulting after we have conducted ourselves in a professional manner at all times during this legal process. And the digital data we requested from the defendants is critical to our case.&lt;/p&gt;
&lt;p&gt;Can you tell me, what are possible legal remedies for such a Bad Faith effort on the part of the defendants?&lt;/p&gt;

&lt;p&gt;How it started:&lt;/p&gt;
&lt;p&gt;I met
a woman on a website. The website is like a forum but a little different. We talked briefly and I broke it off. She got married.
A month after her marriage I had an email exchange with her in which she
suggested that I visit her city. She made veiled references(she is a lawyer) to getting back together. I told her no.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Cyberstalking and Harassment:&lt;/p&gt;
&lt;p&gt;When I came back to the website after a month or so a lot of new fake profiles
started to stalk me. As soon as I would log in they would post a journal and
try to seduce me. There were senior members of the website that were also
making journals helping those fake profiles. They would post romantic journals. I was confused, why would so many people be trying to get me to be
romantically involved with a married woman. I was unsure if it was her so I
sent her an email saying hi. She never replied. But a fake profile made a
comment about someone contacting her. That&amp;#39;s when I realized that she was
trying to &amp;quot;clean&amp;quot; her earlier emails by getting me to contact her.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Going Official:&lt;/p&gt;
&lt;p&gt;I
contacted the website about the stalking and harassment. The admin I talked to
on the phone laughed at me for complaining about harassment. Instead of doing
something about it she sent me an email in which she tried to flirt with me. I didn&amp;#39;t reply. Then a fake
profile posted a journal on the topic of stalking and harassment. I realized
that it was the admin, indirectly revealing to everyone else that I had
contacted her regarding stalking and harassment. I was stunned at the breach of
privacy.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;It gets worse:&lt;/p&gt;
&lt;p&gt;What
followed was group bullying and stalking to cover this thing up. Veild threats of revealing personal information. Ridicule,
taunting and yelling that leaves a person withdrawn and sensitive. Even though I never saw it but the woman had created a facebook page
where she was planning and coordinating all this. The obvious question is why
did I not leave right away and allowed myself to become the village idiot.
Because I kept getting surprised by the involvement of the website employees.
They were giving them my IP, my location, anytime I would login and other information about me. I
contacted the owner to complain about the employees&amp;#39; involvement but he never
replied. He was fully aware of what was going on since he was friends with the
woman.&lt;/p&gt;

&lt;p&gt;In a few weeks I will be operating a website where I give employees advice on how to survive and thrive at work while working with various types of people. &lt;/p&gt;
&lt;p&gt;I am guessing that i will need to put some type of disclaimer on the site letting them know that even though I am college educated, I am NOT a licensed professional and this is strictly advice to them that I have learned throughout my own life.&lt;/p&gt;
&lt;p&gt;My question is what type of disclaimer can I put on here to protect myself down the road from getting sued? I&amp;#39;ve read many self-help books that never seem to have a disclaimer in them. Are books different in that they don&amp;#39;t carry the same liability as websites?&lt;/p&gt;
&lt;p&gt;Any and all help would be greatly appreciated.&lt;/p&gt;

&lt;p&gt;My co-worker &amp;quot;found&amp;quot; some software on a download site on the internet.&amp;nbsp; He downloaded it. (Nevermind what our I.T. department thinks of such things.)&amp;nbsp; It was locked and he apparently tried to call the company that sells it (or sells the key to unlock it) and all he got was an answering machine.&lt;/p&gt;
&lt;p&gt;So he reverse engineered it and started showing off all the great &amp;quot;info&amp;quot; he got from doing this and how we could use it to [our department&amp;#39;s] benefit.&lt;/p&gt;
&lt;p&gt;At that point I said, &amp;quot;You can&amp;#39;t do that.&amp;nbsp; That software is somebody&amp;#39;s Intellectual Property and what you are doing is stealing it.&amp;quot;&lt;/p&gt;
&lt;p&gt;We got into an extended discussion of what he was doing and exactly how he was doing it and why he was sure that wasn&amp;#39;t theft of any kind because after all, &amp;quot;it WAS on the Internet.&amp;quot;&lt;/p&gt;
&lt;p&gt;I was appalled.&amp;nbsp; Our boss finally allowed that if it was &amp;quot;something we were likely to get caught doing&amp;quot; we probably shouldn&amp;#39;t do it.&lt;/p&gt;
&lt;p&gt;I was even more appalled and said that it isn&amp;#39;t a matter or whether we&amp;#39;d get caught or not, theft is theft, and what this co-worker is doing IS theft.&lt;/p&gt;
&lt;p&gt;Everybody was mad at me for &amp;quot;ruining the meeting&amp;quot; and &amp;quot;being mean&amp;quot; to a &amp;quot;nice&amp;quot; co-worker who was &amp;quot;just trying to help.&amp;quot;&lt;/p&gt;
&lt;p&gt;I still think Intellectual Property is Intellectual Property and Theft is Theft.&amp;nbsp; The mere fact that my co-worker couldn&amp;#39;t reach the owner of the IP on the first attempt to place a phone call, doesn&amp;#39;t doesnt make it any less Theft.&lt;/p&gt;

&lt;p&gt;A week later on march 16th 2010 i read an article online that said president obama cancels family trip to indonesia and australia. He was going solo with his staff while&amp;nbsp;his family&amp;nbsp;stayed home.&lt;/p&gt;
&lt;p&gt;On march 17th 2010 i sent an email to whitehouse.gov through their electronic form. The email said &amp;quot;dear obama, please spend more time with your kids. When i was a kid my father wasn&amp;#39;t around that much and if you put make your family a priority everything will fall into place.&amp;quot;&lt;/p&gt;
&lt;p&gt;On march 18th President obama cancelled his trip. An australian news source said the prime minister was happy to hear the president would be returning later in the summer with his family.&lt;/p&gt;
&lt;p&gt;Around a week later ICU Wireless opened up business around the corner from my house. The company sold no contract cell phones and car stereos. I found it strange that they sold car stereos as well. &lt;p&gt;In the past my company Bite The World Productions, LLC produced 2 online videos for the cabell county executive committe. I was paid $100 for each one and then uploaded them to youtube.com/cabellgop.&lt;/p&gt;
&lt;p&gt;My theory is just maybe my email upset the President and he decided to send the cia to collect intelligence on me for politcal gains in upcoming elections. I am basing this theory on emails sent to news organizations, unreturned phone calls to cyber lawyers at harvard law, intercepted text messages to and from my friends cell phones. Friends who wanted me to travel to san diego, 2 days later i would recieve their messages. I notice a large amount of traffic cameras that were installed across the city of Huntington, WV as well.&lt;/p&gt;
&lt;p&gt;I did a little research on the FOIA and sent out several requests. The Department of Defense security service cited excemptios 6 and 7c. The office of the National Reconssanice office also cited excemptions explaining that they had no unclassified documents. My request to the air force was never processed because it was too broad. I have never worked for the air force but i did notice that after i emailed the president the air force opened up a cyber command department. My request to the NSA cited an executive order from the president and no documents were retrieved. I mailed and faxed out a request to the CIA and never got a response. This was 3 weeks ago.&lt;/p&gt;
&lt;p&gt;Ive contacted my local ACLU affillate but bc i did not research filling out the required forms it was rejected. I mentioned patriot act and a possible scandal but my affilliate is small and only handles a few cases a year.&lt;/p&gt;
&lt;p&gt;I am unsure if my email to whitehouse.gov was connected to an email i sent out to my senator jay rockefeller. he is on the senate committe of intelligence. that email read, &amp;quot;you will not get reelected if net neutrality goes through.&amp;quot;&lt;/p&gt;
&lt;p&gt;I am looking for a lawyer to assist me in filing&amp;nbsp;&amp;quot;perfected&amp;quot; pa requests to reach a definitive conlcusion if the govt has any documents indexed to my name. If my theory is correct those documents would lead me to file a complaint in federal court and open up a criminal case. &lt;/p&gt;
&lt;p&gt;I am looking for any advice on filing perfected requests. The buyer paid for it through&amp;nbsp;Paypal. My husband shipped it out with insurance. The buyer claimed it arrived broken so my husband told him he must file a claim with USPS.&lt;/p&gt;
&lt;p&gt;&amp;nbsp; The buyer asked him to file the claim. My husband&amp;nbsp;looked into it&amp;nbsp;and told him that since he had the broken statue he had to file the claim.&lt;/p&gt;
&lt;p&gt;&amp;nbsp; Next the buyer claimed that it was misrepresented in the auction and that what he received was not what it was stated to be. He wanted his money back. My husband told him he could refund his money but he had to return the statue.&lt;/p&gt;
&lt;p&gt;&amp;nbsp; So the buyer &amp;nbsp;filed a claim with Ebay/Paypal. Paypal contacted us and we explained our position. They told us we had to refund the money. My husband refused on principle.&lt;/p&gt;
&lt;p&gt;&amp;nbsp; Paypal refunded&amp;nbsp;the buyer&amp;nbsp;his money and then demanded that we reimburse them.&amp;nbsp;My husband refused on principle.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;Now, several years later we have begun receiving collection notices in the mail.&amp;nbsp;We moved three years ago and somehow they found our new phone and address.&amp;nbsp;&lt;/p&gt;

The travel services we sell are provided by a very large online company (&amp;quot;company&amp;quot;) through an affiliate program. (e.g. think of the relationship between Amazon, and website owners who sell Amazon products through their website).&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;In the beginning, we used the company&amp;#39;s white-label platform to display the products we sold. i.e. we did not need to do huge amounts of programming to have a website up and running. However 1 year ago they required that we develop my own multi-language platform that would integrate their products using an XML feed. We were given a 4-month deadline to complete this.&lt;/p&gt;
&lt;p&gt;This was a large investment in terms of money, but also in time. ( although we launched within 3 months, we are still fixing bugs and making optimizations 15 months later. I have been working at this full time for the last 15 months, but have also employed programmers, designers, etc..). Whilst this was a lot of work, we now have our own in-house website which is set up to sell specifically the provider company&amp;#39;s products.&lt;/p&gt;
&lt;p&gt;Last week, my contact at the provider company sent us an email saying that they have changed their policy and they no longer allow affiliates, old and new, to use Search Engine Marketing (i.e. advertising on search engines, like we do), to drive traffic and sales to their product. &amp;nbsp;This policy would bring our entire business to a halt, as we rely exclusively on Search Engine Marketing to bring visitors to our website to then sell them the travel product from this supplier.&lt;/p&gt;
&lt;p&gt;I have checked our affiliate contract and although in it, Search Engine Marketing is allowed, it does say that the parties may terminate the contract at any time for any reason.&lt;/p&gt;
&lt;p&gt;Is this legal? One year ago the company required us to make huge investments in time and money to develop our own platform (but this platform only works for their product!!), and now they want to disallow us advertising our websites? &amp;nbsp;Would they be allowed to just terminate our contract like this, or would it go against the principles of fair competition?&lt;/p&gt;
&lt;p&gt;To me, it seems that the company has made a strategic decision that they do not want their own affiliates to compete with them in Search Engine Marketing. There is no other reason that makes business sense for which they would not allow us to advertise our website.&lt;/p&gt;
&lt;p&gt;I have been given 1 month to comply. Can they really terminate our business like this, and what can we do?&lt;/p&gt;
&lt;p&gt;Even if we could find an alternate supplier (which I don&amp;#39;t think would be as good as they are the leaders in the sector), it would take at last 18months to develop a suitable platform and gather enough research to launch a suitable replacement website!&lt;/p&gt;

Now that I have called him out on tons of red flags it appears he does not answer my calls anymore. Here are the red flags...&lt;/p&gt;
&lt;p&gt;1. David will always gives me&amp;nbsp;the run around. Saying things like it takes longer than expected.&lt;br /&gt;2. Their 888-358-2766 does work, but extension 701 always is voicemail. All the other extensions no body answers either.&lt;br /&gt;3. Extension 703: David answers then says to try the other extensions when those ppl don&amp;#39;t exist.&lt;br /&gt;4. He told me he was just the sales guy and when I asked him to go hand the phone to the manager or the tech that was working on my case he would just make something up on the fly making it look like they were busy or not around.&lt;br /&gt;5. Their WHOIS on their web site is Moniker Privacy Services 20 SW 27th Ave. Suite 201 Pompano Beach, FL 33069 US Phone: +1.9549848445 &lt;/p&gt;
&lt;p&gt;I google mapped their address (1329 W. Main St. #230 Salem, VA 24153) and it shows a K-Mart in that location. I called a local UPS Store that had the same address and one of the workers told me it was their address and that was the mailbox number.&lt;/p&gt;
&lt;p&gt;I&amp;#39;m not sure how to subpoena the UPS Store for this mailbox&amp;#39;s information and would need some help on how to go about doing this. Even if I subpoena the ups store for this information I do not know if it&amp;#39;s going to be fake info. So I was wondering how I could go about tracing the fax number they are using as well. I would like to sue this guy/company as well for all the damages it will cost me as well.&lt;/p&gt;

&lt;p&gt;My husband filed an unemployment claim anyway and we thought it would be an win for several reasons.&amp;nbsp; The IT provided internet logs along with a written testimony saying that he observed the internet activity on a specific date.&amp;nbsp; The internet logs themselves contained no dates only time stamps,links and a IP address.&amp;nbsp; One of the days listed by the IT guy my husband wasnt even in the office he was at the job site where he had no access to a computer. Another of the days he was home for at least half the day and the time stamps on that log showed access to the porn links from his company computer after he was already home.Also none of the company computers have a personal log on, they all use the same ID and password.&lt;/p&gt;
&lt;p&gt;My husband defended himself because we thought there was no way a judge would take the internet logs as proof without them at least being dated and with my husband being able to prove he wasnt even in the office at least part of the time the logs were dated for but we were wrong The judge never even asked my husbands employer about the days he wasnt in the office and my husband lost his unemployment appeal. &lt;/p&gt;
&lt;p&gt;My husband is working again now but the whole thing still bothers us, we nearly lost everything we had and we had to move away from our home just to survive those months before my husband found another job. I want to know if there is a case and if there is would it be worth the time and money to pursue it, its not about the money anymore its the fact that a company did that to my husband and he didnt do anything wrong and it nearly destroyed my families financial future and not only caused us to have to move away from our home but it took several months for my husband to find another job and has caused him problems because its hard to explain to a potential employer that you were fired from you last job because you were falsly accused of surfing porn during work hours. &lt;/p&gt;
&lt;p&gt;It should be noted to that the company also fired at least 7 other people during this time, all of them for varying reasons and layed off at least 2 others.&amp;nbsp; I cant help but think this was a setup, they couldnt find anything else to fire him for so they made one up and they didnt want to lay him off because his contract called for a hefty serverence package in the case of a lay off.&lt;/p&gt;

He then re-posted those posts on his site, along with my name, e-mail address (he even found a photograph of me and posted that) to try to prove his point of view. When I tried to respond to his rants concerning me on his site, I found that he had stopped my ability to do so via my IP address; I no longer have access to the site. &lt;p&gt;I am a member of an online auction site with its location in the State of Georgia.&amp;nbsp; I reside in Maryland, and the&amp;nbsp;buyer resides in New Jersey.&lt;/p&gt;
&lt;p&gt;The Members Agreement which both of us (me as the seller and Peter as the buyer) agreed to states the following:&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;quot;1.&amp;nbsp; &lt;b&gt;Bidding.&amp;nbsp; &lt;/b&gt;Placing a bid on an item is an irrevocable offer to buy the item(s) at the price in the bid, provided the bid is a winning bid at the time of the close of the auction. A winning bid is a bid that is the highest bid on an item, or in the event of a tie, the bid placed chronologically earliest. In the case of a reserve price auction a bid is only a winning bid if it meets or exceeds the reserve price on the item. In the case of a Dutch auction there may be more than one winning bid depending on the quantity of items available and the number of bids placed. &lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Placing a bid constitutes entering into a binding legal agreement with the seller to purchase the item(s) at the winning bid price and in accordance with the terms stated in the item listing and the rules of this site. You must resolve any questions about the item by contacting the seller of the item &lt;b&gt;prior&lt;/b&gt; to placing a bid. &lt;p&gt;Given the Member&amp;#39;s Agreement is very clear on his obligations, and the fact we are in two different states, if I decide to pursue this in Small Claims Court, which state would I file my claim?&amp;nbsp;&lt;/p&gt;
&lt;p&gt;What protections do I have as a seller to receive payment for my item (I have not shipped the item until I receive payment).&lt;/p&gt;
&lt;p&gt;I am aware that I could simply re-list the item for sale again, but there is no gaurantee that it will sell for that price and I made a significant investment in this item to resell it.&lt;/p&gt;

&lt;p&gt;The relative was advised to get a Cease and Desist ORDER, as sending a C&amp;amp;D letter would just be thrown in the trash.&amp;nbsp; The person tried to contact PJ but was ignored on all fronts.&lt;/p&gt;
&lt;p&gt;Here&amp;#39;s the issue.&amp;nbsp; Hiring a Lawyer to put together the order is way, way, out of the relatives financial capability.&amp;nbsp; He&amp;#39;s tried Legal Aid, ACLU, and called every local Lawyer and pretty much begged for pro bono help.&amp;nbsp; None was found.&amp;nbsp; &lt;/p&gt;
&lt;p&gt;Is my relative&amp;#39;s identity ruined forever?&amp;nbsp; Are there ANY lawyers out there that do pro bono internet defamation/libel cases?&amp;nbsp; Are there any other ways to get a C&amp;amp;D order, not a C&amp;amp;D letter?&lt;/p&gt;
