    Paying back an SSDI Overpayment Procedure

    Recieved a notice a little over a month ago that I may have been overpaid SSDI about 4 years ago.  It said they will send me notice when they make the final determination. I intend to set up payment arrangements from my SSDI check if the information is correct. Overpayment period was a couple years before I got married and before I even knew my husband (I got married 6 months ago).

    If I get an overpayment notice and set up monthly payment amounts with SSA and abide by them without missing payments. Can SSA still take my tax refund checks I file jointly with my husband? Can they levy his or my personal bank accounts? Garnish his wages? If I was ever well enough to return to work in the future garnish mine? Or is it provided that I honor the payment arrangement will SSA leave our accounts, tax refunds and his check alone? What additional measures can SSA take to collect IF I am already honoring a payment agreement. Thank you for your time ready this.

    My daughter has been drawing SSD since she was 15 years old. They have been taking an overpayment out of her checks for the past few years. They will not mess with your husbands accounts.

    I imagine that SSA will tell you how much they are reducing your checks by. And it won't be voluntary. So you don't have to worry about all that stuff because they'll get theirs before you get yours.

    Why don't you call up and ask how it works.

    When they make that final determination, call them up (not that 800 number) and make a deal to have the overpayment deducted from your ongoing payments.  Don't offer $10 a month as that probably is too low.

    Almost any repayment offer that gets the overpayment amount repaid within three years probably will be accepted.

    Don't be surprised, however, if you wind up paying interest.  It won't be as onerous as with a credit card, but I am guessing that you'll pay some interest.  It's probably pegged to a T-bill rate.
