    Hospital Bills

    I was working part time for a printing company three [3] years ago. I was driving the company car, and it was snowing and I sled through a red light and hit another vehical which resulted in me having a back injury. I went through all the stuff with workmans comp I mean I had Physical therapy for a total of 38 times, My doctors said I was OK to go back to work [but I never did, Im retired] by the way my back is a lot worse now then it has ever been, I mean I can't lift anything without suffering for days afterward. I never went back and complained because the accident was my fault. Well anyway I just got a bill from the Hospital for X-Rays that where done on 03/15/2007. My question is can the Hospital come back at me after three years for payment of these X-Rays or can I tell the Hospital to bill the insurance company. Please give me some advice.  &nb...

    Yes.

    You were the patient. You incurred the charges. You are responsible for them.

    You can "tell" the hospital anything you want. But that isn't going to change anything if they don't get paid and keep coming after you.

    I suggest that you call the WC insurance company that handled the claim and find out what happened and what the company will do about it. CALL TODAY!

    Since the WC company paid for your PT and wages, it should also have paid for the rest of it.

    Don't snooze on this. The hospital doesn't care where the money comes from as long as they get it and it's not up to them to deal with the insurance company at this point.

    By the way, since your back is a lot worse and can be traced back to the accident, you might want to re-open your claim and get additional treatment.

    If you have a recognized WC claim (and it does not matter if the MVA was your fault or not) then you are not legally responsible for the medical bills.  I suggest that you contact an attorney for a consultation.  It should  be free.

    I agree with Fred, you should contact an experienced workers' compensation attorney immediately.  This is a no-fault system, so it does not matter who was at fault in the MVA.  Also, be aware that, if your claim is not legally accepted, you only have three years from your date of injury to file a Claim Petition with the Bureau of Workers' Compensation.  If this time period expires, you may be forever barred from receiving any workers' compensation benefits (wage or medical) for your injury.
