    Question [=?] Dental Malpractice Dilemma

    I would appreciate some advice as to whom I should seek representation from and how I should proceed regarding a dental malpractice matter. I have obtained my patient chart from the dentist as well as x-rays of the area of concern. I have sent letters to the dentist explaining my position and requesting, at minimum, a refund of monies paid as compensation. The events all have transpired within the past year.

    The issue at hand is the use of a 'cast post and core' in the final restoration of two teeth following root canal therapy and the negative consequences of doing so. Also relevant, is the dentist's lack of explanation and no consent given by me, as the patient, for such a method to be employed without the risks first explained. I have incurred debts and suffered pain in the attempts to correct the use of this material. One tooth will have to be extracted and the other has already undergone an apicoectomy.

    Who you seek representation from is a dental or medical malpractice attorney.

    How you proceed is you file a lawsuit if the dentist doesn't respond to your demands.

    Many states have a Dental board that will mediate complaints like this between a patient and their dentist at low or no cost avoiding court.  They look at all the facts including the documentation of what the dentist did or didn't do and if they find the care is substandard they order that the patient be compensated.  

    Check and see if your state has such a board.  It will be faster, easier, and cheaper than a med/mal suit.
