    Changing a child name on Birth Certificate

    I have court ordered papers that I am the biological father with Joint custody and have domiciliary of my child. I have in my court orders The parites shall work together to promptly sign any and all docuaments which are necessary to change the child name to the fathers name and list myself as the father on the the child birth certificate.  My problem is the legal father will not respond to phone calls, text messages, emails, talking to his mothers, and mail to come in and sign his name acknowledging that he will take his name off the birth certificate, becuase in order to do all of this we have to have both the biological parents and him there.

    is he in contempt in court?  can I file for child support becuase legally his name is on the birth certificate and still with responsible? ( which there is a case that has a child with 2 fathers that pay child support).

    He's not the legal father in the eyes of the court so no you can't ask for child support from him.  But if you're not living with mom then you can seek support from her. 

    I'm sure if you went back to court and stated that he was not making any effort to follow the order they could over rule the need to have him sign anything and just re-issue a new birthcertificate based on the courts findings.
