    left job due to moving

I worked for a large company , In the begining I started out with 19 hours a week. I was already working a part-time job 10-12 hours a week. The two jobs allowed me to have a full time income.

Things began to change, new stores were open and my hours increased with my first job. Rumors were circulating that we were going to loose our job due to the company loosing the account. So as hard as it was I stayed on with the part time job, about $90 a week. As time went on over the year we were re-evaluated, job discription changed ,hours changed, work changed to standing for an 8 hour day two to three days a week in addition to travel. They called us out of town for a meeting in March and ask who wanted to leave to do it now. I hung in there thinking things would improve ,they did not. We received our letter of seperation and were told our last day was July 9,2010. So my husband and I looked at our situation and decided to make a major move. We could no longer make our house payment and decided to move to an area that was doing ecomically better . I stayed on my second job and gave my notice on 7-21-10, I did not go into detail that my house was going into forclosure and I was selling my car and my daughter has post partum depression and my husband and I at the time were going to have a baby to raise, I just told my employer it was a personal decision because they told me not to go into detail just to write a short note of resignation so I did.

But as I submitted my claim with UN I did go into some detail. The reason I quit the part time 10 hour job is because

#1 The company does not hire any full time employees

    #2 Relocating

I received a denial letter and the reason given was that the reason I quit was personal.

I am actively searching for work in the county we are moving to I am registered with UI and have a resume on their website and also a website called Narms and Indeed for the type of work I do.

Thanks , I pretty sure your news is not going to be favorable but I'm going to appeal with hopes someone will see the position I am in.

Sorry, but you are correct, it isn't favorable.

    • Florida statute 443.101 Disqualification for benefits.
    • An individual shall be disqualified for benefits:
    • (1)(a)  For the week in which he or she has voluntarily left his or her work without good cause attributable to his or her employing unit...As used in this paragraph, the term "work" means any work, whether full-time, part-time, or temporary.

    http://law.onecle.com/florida/labor/443.101.html

The statute defines work as "full-time, part-time, or temporary." That you quit a part-time job because the employer doesn't hire any full-time employees is not "good cause."

That you quit because you had to relocate due to personal financial issues is also not "good cause."

I believe that you would have been entitled to partial benefits from the full-time job had you remained employed on the part-time job.

In fact, you should have filed on July 9 when you lost the full-time job. You would have been disqualified once you quit the part-time job but at least you might have gotten a few weeks worth of benefits.

It doesn't cost you anything to appeal. But it would be a good idea to talk to an unemployment law attorney and see if there is any case law in Florida that might contradict my conclusions.

Re: left job due to moving

I agree--you probably had a vaild claim when your were separated /let go without cause from your first job----and there would have been a modest offset for your PT work.

But as to PT job you quit you are now sunk as you quit.  You can try to file for UC based on first job  but I think the fact that you turned down available work (even PT)  is likely fatal

Some states allow for a trailing spouse exception--to quit to follow a spouse who moves still allows for UC--but I'm not sure in FL has any such exception --I suspect not.
