    WOW the wicked web she weaves

    My ex last week decided to consider suicide.  She was hospitalized for 4 days.  It is my understanding she did not actually try to but considered it and the wrong people heard and put her in the hospital for it.

    Having said that I have physical custody of our children.  They go to moms every other weekend and 4 hours during the week.  She has totally brainwashed one child, and something cracked in the second child when she tried to commit suicide and now he wants to live with her.  She is using this mental abuse of saying I am going to kill myself to get the kids to act up and want to live with her even though I have a more stable living arrangement and income.  I am morrally right for them as she is more and more going wrong. 

    Is it in my best interest to file a protection order in their behalf  against her?  I have one already against her for myself as she has called police and DFS on me unfounded claims over and over.  Now she is starting to wear on our children. 

    If I file for a protection order and cite her escapades and the latest of trying to commit suicide and telling the kids when they act up she should have just killed herself, is that enough to keep them from her and request a full psychiatric evaluation?  Would they have to attend court?  I know if they did and the judge asked where they wanted to live they would say with mom due to all of her threats of suicide. 

    So, is a protection order something that could be issued to keep her away until she gets a full mental evaluation upon competency and her mindset?  I am lost here....  it is tearing our kids up incide putting a lot of pressure on them to save moms life.

    It is a custody issue; you would file for a mental health evaluation in the custody case;  not an issue for a protec tion order.

    How old are the children?  They are probably not of an age where they understand the strategic ramifications of what they are saying.

    The odds of you getting a protection order is not likely; however, you can try to get supervised visitation based on what you've posted using the false reports and suicide hospital admission.  You can also petition for a complete psych eval for mom; it may or may not be granted since she was released (not retained) by the hospital.

    It isn't likely the judge is going to interview the children.  That is a rare instance and depends on the age of the children and surrounding events.

    I would also consider getting the children counseling.  they will continue to get messed up as this progresses without professional assistance.
