    She was ordered to go back to maiden name but hasn't done it

    She was ordered to go back to maiden name but hasn't done it yet after five months. She has been using my last name to file for loans also. Should I file an order to show cause ? Also she is in deportation hearings because the marriage was fraud and I was successful in getting a decree of annulment.

    You aren't likely to be responsible for her loans.

    I wouldn't jump on spending money on a lawyer just yet.

    You might think the last name thing is a big deal, but it really isn't.

    Pick your battles. The last name isn't one of them. Getting rid of her is the one you need to concentrate on.

    I think I'd wait and see how the deportation hearings play out. If she gets thrown out of the country, you're done with her, no matter what her name is.

    It would be incredibly uncommon for a court to order someone to change their name.  Are you sure that the decree didn't state that she could change her name (not that she must)? How does her using the same last name as you cause you any harm?

    Was the order that she MUST change her name back or that she COULD change her name? Normally the wife has the option.

    I'd want to focus on having her deported?

    If the order says stop using your name then a contempt citation for same might be useful to pile on as a reson to deport her...I'm not sure its a crime of moral turpitude --but check it out.

    If she was using the wrong name as per order to apply for loans you might posture that as intent to to deceive but I don't know how to make it stick.

    I'd want to be at the deportation hearings---
